4. Payment Terms and Conditions
Fees for the Services, including any rental charges, registration fees, deposits, late fees, administrative fees, or other amounts, will be disclosed at the time of booking, purchase, or registration, or otherwise communicated to you in writing.
- All fees are payable in the currency indicated at the time of purchase or booking.
- You authorize us and our payment processors to charge your selected payment method for all applicable amounts.
- You are responsible for ensuring that your payment details are valid and that sufficient funds or credit are available.
- We may require prepayment, partial payment, a security deposit, or a deposit to secure a booking.
- Taxes, duties, and similar charges may apply depending on the nature of the transaction and the applicable jurisdiction.
If a payment is declined, reversed, disputed, or otherwise not received in full, we may suspend or cancel the relevant booking or Services, and you remain liable for any amounts due, including reasonable collection costs where permitted by law.
We reserve the right to correct pricing errors, provided that where required by law, we will give you the option to proceed at the corrected price or cancel the affected order or booking.
You agree not to initiate a chargeback except where the charge is unauthorized or otherwise improper under applicable law. Any payment dispute should first be raised with us at [email protected].
5. Cancellation and Refund Policy
Cancellations and refunds, if any, are subject to the applicable booking terms, event-specific rules, and the policies disclosed at the time of purchase or reservation. If no separate policy is provided, the following default rules apply unless prohibited by law:
- Facility bookings: Cancellations made within the specified notice period, if any, may be eligible for a refund or credit. Late cancellations may be non-refundable in whole or in part.
- Programs, camps, clinics, and registrations: Fees may be partially refundable only if cancellation occurs before the program begins and subject to administrative deductions, third-party costs, and any non-recoverable expenses.
- No-shows: Failure to attend a scheduled booking or session may result in forfeiture of all or part of the payment.
- Weather or safety-related changes: We may reschedule, modify, or cancel Services due to weather, safety, maintenance, staffing, or operational issues. In such cases, we may provide a rescheduled service, credit, or refund, at our discretion and as required by law.
Refunds, where approved, will be issued to the original payment method where reasonably possible and may take a reasonable time to process. Any bank or card processing delays are outside our control.
Nothing in these Terms limits any non-excludable rights you may have under applicable consumer protection law in Canada or otherwise where such law applies.
6. Liability Limitations
To the fullest extent permitted by applicable law, Madrid Football Facilities S.L., including its directors, officers, employees, agents, contractors, affiliates, licensors, and payment processors, shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost opportunities, data loss, business interruption, or reputational harm, arising out of or relating to the Services or these Terms.
To the fullest extent permitted by law, our total aggregate liability for any claim arising from or relating to the Services or these Terms shall not exceed the amount paid by you to us for the specific Service giving rise to the claim during the three (3) months immediately preceding the event giving rise to liability, or CAD $100, whichever is greater, except where such limitation is prohibited by law.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for gross negligence, wilful misconduct, fraud, or death or personal injury caused by negligence where such limitation would be unlawful.
You acknowledge that participation in Soccer Point and related physical activities involves inherent risks, including collisions, slips, falls, overexertion, weather exposure, equipment misuse, and actions of other participants. You voluntarily assume all risks ordinarily associated with lawful participation in such activities, except to the extent caused by our gross negligence or wilful misconduct, or otherwise as prohibited by law.
